CROSS 1821 file
State
of North Carolina }
Gates County } In Equity
To the Honbl. the Judges of the Court of Equity for the County aforesaid
This bill of complaint of Priscilla CROSS of the County and State aforesaid
shews your honor that one James CROSS the son of your -orator- [crossed
out] /oratrix/ [interlined] departed this life in the year 1821 intestate
having as his only distributees brothers & sisters and your oratrix.
That administration upon the estate of the said James was committed
to one -Edward- /Elisha/ CROSS a brother of the said James who duly
qualified himself for the discharge of the duties of said office, and
as such administrator collected the debts due the said James and reduced
the other personal assets of his intestate into? possession, and paid
off the debts due from the said James and then died having a large fund
due -of- the distributees of the said James of one thousand five hundred
dollars or more. That upon the death of the said -Edward- /Elisha/ CROSS
intestate administration upon his estate was committed to one Abram
CROSS of the said County who took into his possesion all the estates?
in action and personal assets of his intestate into his possession amounting
to five thousand dollars or more. That the said Abram being impressed
with the belief that as the [2nd page] administrator of the said -Edward-
/Elisha/ he succeeded to the rights of the personal representative of
the said James, took into his possession all the funds which the Said
-Edward- /Elisha/ held belonging to the estate of the said James and
distributed the Same at different times among the distributees of the
Said James, with the exception of Sarah LENNON to whom he never paid
any thing, and charged such payments in the accounts kept by him as
the administrator of the said -Edward- /Elisha/ CROSS. That the said
Abram as the administrator of the said -Edward- /Elisha/ in the year
1824 procured the Court of Pleas & Quarter Sessions of the said
County to appoint certain respectable individuals to State and audite
his accounts as the administrator of the said Edwin [sic] which account
so stated the said Abram returned to the Court of Pleas and Quarter
Sessions of the Said County and in it the said Abram Charges the estate
of the Said -Edward- /Elisha/ with the Sum of one hundred & Eighty
one 16 1/2/100 Dollars "the amount of Kurstook [sic] WATSON &
wifes claim not applied for" all of which will appear by reference
to the said account now on file in the /Clerks/ office of the said Court.
Your oratrix further Charges that the said Kurstook WATSON spoken of
in the said entry of the said account [3rd page] intermarried with -Sarah-
the said Sarah who is a sister of the said James in the year [blank]
he being at that time a resident of South Carolina, where he and the
said Sarah continued to reside until the year [blank] when the said
WATSON died leaving the said Sarah Surviving. That the said Sarah has
since married one Moore LENNON of the County of Columbus in the State
of North Carolina, and that the said Sarah and her present husband Moore
LENNON have by a deed bearing date the 10th day of May 1834 bargained
transferred and assigned to your oratrix the distributive share of her
the said Sarah of the estate of the said James CROSS, and that by virtue
of the said assignment your oratrix is well entitled to to [sic] receive
the same. Your oratrix shews your honour that Since the said assignment
has been executed to her, she has by her frinds? applied to John R NORFLEET
the administrator of the said Abram CROSS, the said Abram having departed
this life some time in the year 1830, for the payment of the said distributive
share, which he has refused to do, and that previous to the Said assignment
as well in the life time of the said Abram as since his death -applications-
similar applications have been made with no success. Forasmuch as [4th
page] Your oratrix is remediless in the premises at will? by the strict
rules of the common law, and can not have adequate relief save in a
court of Equity, where matters of this sort are cognizable and relievable
To the end therefore that the said John R NORFLEET may /upon his corporal?
oath/ careless? assets of his testator, and that he may answer the premises
in as full and ample a manner as if the Same were here repeated and
be specially interrogated thereto, and that he may be decreed to pay?
to your oratrix the full amount that was due the said Sarah as one of
the distributees of the said James, And for general relief. And may
it please your honor to grant to your oratrix a writ of Subpoena with
a copy of this bill to be served upon the said John R NORFLEET administrator
of the said Abram to appear &c. And your oratrix will ever pray
Aug MOORE Sol for Compl.
